Terms & Conditions.
These terms govern bookings, communications and any other use of services provided by Jimmy and Jason Ltd. Please read them carefully — by making a booking with us you agree to be bound by them.
1. About these terms
These terms and conditions (the "Terms") form a binding agreement between you (the "Guest") and Jimmy and Jason Ltd ("we", "us", "our"), a company registered in England and Wales (company number 15603187), with its registered office at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. We trade under the name Jimmy and Jason.
By submitting a booking enquiry, signing a booking confirmation, or paying any sum to us in connection with a stay, you confirm that you have read, understood and agreed to these Terms on behalf of yourself and every member of your travelling party.
2. Our role
Jimmy and Jason acts as a curated booking agent and concierge intermediary between you and the legal owners or managers of the private villas listed on our website (each, a "Property"). Unless expressly stated, we do not own the Properties, nor do we directly employ the resident staff. Our contractual role is to arrange the booking, collect payment, provide a concierge service, and stand alongside you for the duration of your stay.
The contract for occupation of the Property itself is between you and the Property's owner or manager. Where helpful, we will provide you with the relevant owner's terms before you book.
3. Making a booking
3.1 Enquiry & quote
All published nightly rates are indicative and subject to availability. A booking is formed only once we have issued a written booking confirmation that includes the Property, dates, guest count, total price and payment schedule, and you have paid the required deposit.
3.2 Lead guest
The person who completes the booking is the "Lead Guest". The Lead Guest must be at least 21 years old, have authority to bind every member of the party, and remain the point of contact throughout the stay.
3.3 Capacity
The number of guests must not exceed the maximum stated in the booking confirmation. Day visitors, additional guests and events on the Property require prior written approval.
4. Payment, deposits & taxes
Unless otherwise agreed in writing:
- A non-refundable deposit of 30% of the total price is due at the time of booking. Bookings within 60 days of arrival require payment in full.
- The balance is due no later than 60 days before arrival.
- A refundable security deposit may be required on arrival; see section 7.
- All prices are quoted in pounds sterling (GBP). Taxes applicable in Morocco are included unless otherwise stated.
We accept all major credit and debit cards, bank transfer in GBP/EUR/USD, and (by prior agreement) cash on arrival for top-ups.
5. Cancellation & changes
If you need to cancel, please notify us in writing as soon as possible. The following standard scale applies unless your booking confirmation states otherwise:
- More than 60 days before arrival — deposit forfeited.
- 30–60 days — 50% of the total price.
- Less than 30 days — 100% of the total price.
We strongly recommend you take out comprehensive travel insurance that covers cancellation, curtailment, medical expenses and personal liability.
Date changes are subject to availability and may incur an administration fee. We will not unreasonably refuse a date change requested at least 60 days before arrival.
6. Guest responsibilities
By staying at one of our Properties you agree:
- to treat the Property and its staff with care and respect at all times;
- to comply with the house rules supplied at check-in and any reasonable instruction from the resident team;
- not to host any event, party or commercial activity at the Property without our prior written consent;
- not to use the Property for unlawful purposes, and to observe local laws in Morocco;
- to leave the Property in a similar state of cleanliness and order as on arrival.
7. Damage & security deposit
A refundable security deposit may be requested at check-in (typically held by card pre-authorisation or cash). It is released within 14 days of check-out, less any reasonable amount required to repair damage beyond fair wear and tear, replace missing items, or cover excess cleaning.
Where damage exceeds the security deposit, the Lead Guest is responsible for the difference.
8. Liability
Our liability under or in connection with these Terms is limited to the total sum paid by you for the booking in question, except in respect of (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, and (c) any other liability that cannot lawfully be excluded.
We are not liable for matters outside our reasonable control, including those described in section 9 (Force majeure).
9. Force majeure
Neither party is liable for failure to perform its obligations to the extent caused by events beyond its reasonable control, including (without limitation) acts of God, war, terrorism, civil unrest, government action, epidemic or pandemic, fire, flood, earthquake, severe weather, strikes, or significant disruption to international travel.
Where such events prevent your stay, we will offer (at our reasonable discretion) a credit, a rescheduled stay, or a refund of sums not already paid to third-party suppliers.
10. Complaints
If anything is not as expected, please tell us during your stay — most issues can be resolved on the spot if we know about them. Email contact@villasinmarrakech.co.uk or WhatsApp the concierge on +44 7458 148 227. Complaints raised only after check-out are very difficult to investigate fairly.
11. Governing law
These Terms, and any non-contractual obligations arising from or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute, save that we may bring proceedings against you in the courts of your habitual residence.
